WEBORAMA GENERAL CONDITIONS OF USE Weborama's main activity in France is to provide a webmasters oriented service to measure the traffic and identify the audience of web pages. Thus, it enables to create an interactivity between their website(s) and their visitors; Weboscope Free. In return for this service, the web pages must carry the Weboscope logo and Weborama may use them as a sales promotion space. (see art. 5). 1- PURPOSE This current contract sets the general conditions of use of the service for the subscribers holding a Weboscope Free account at Weborama. Before registering, the subscriber declares herself/himself to be in agreement with the applicable law and these general conditions of use. 2- CONDITIONS TO ABIDE BY BEFORE OPENING A REGISTRATION ACCOUNT Weborama's Weboscope Free service registration is free. To open an account and use the service, the user must fill in a registration form. On that occasion, the user commits herself/himself to provide fully and truthfully information and to update them in case of modification as soon as possible. Weborama's Weboscope Free service registration is for English spoken websites which obey to the applicable law (see § 6 Content of registered websites). For bilingual websites, the Weboscope Free service can only be used on the English spoken part of the website. Besides, in order for each website to be processed in a comparable manner using the same measurement method, the user is compelled to open only one account per website. In the case of a user who handles the management of several independent websites (i.e., they don't have any links between each other), she/he may open as many accounts as websites. 3- ID AND PASSWORD Each account is characterised by an ID, a login and a password which enable the user to access Weborama services. The password is personal and confidential. The user is responsible for the use of her/his password and guaranty to keep it secret and not to reveal it under any circumstances. 4- REGISTRATION SUBMISSION TO THE WEBOSCOPE FREE SERVICE To submit its registration and the access to the Weboscope Free service, the new user has to install the HTML codes provided by Weborama within 10 days from the day of registration. 5- LIMITS OF USE OF WEBOSCOPE FREE SERVICE As a free tool of traffic measurement and audience profiling on Internet, Weboscope Free provides the users with a set of statistics such as: number of visitors (during the day), number of visits, number of viewed pages, profile of identified visitors (age, gender, socio-professional group)... These statistics are updated once a day (at 12.00 midnight), and available at any time on Internet thanks to the ID, login and password of the user’s account. Visit counting is performed through the Weboscope logo which is directly inserted in the audited pages. The logo must be visible on the website and cannot be modified or hidden on the entire page. Weborama reserves the right to display sales promotional adverts for its different services and/or advertisings on (or through) this logo and/or any messages of its choice under any format (e.g., pop-up, pop-under, interstitial ad, etc.) and without limit. The webmaster gives up her/his rights on this space which is considered as a Weborama property (she/he may of course, at any time remove the Weborama codes without notice). In the scope of its measurement activity, Weborama identifies anonymous behavioural profiles as the navigation progresses on the different audited websites. These profiles cannot identify personally a web user. They remain the exclusive property of Weborama. Any web users may refuse to be recorded by Weborama. They just have to read our Privacy Policy and install the "Opt-Out" cookie. 6- CONTENT OF REGISTERED WEBSITES - PRIVATE AND GOODS RIGHT The user promises to meet the applicable law regarding identification, use, communication and display of a website. Notably, she/he commits herself/himself to not display directly or indirectly any message or information whatever its form or nature: * In opposition to public order and morality, featuring paedophilia or pornography. * Dissemination of insulting, defamatory, racist, xenophobic, homophobic, revisionist contents. * Encouraging discrimination, hate towards a person or a group of people regarding their origin or their ethnic group, their nation, their race, or religion. * Threatening a person or group of people. * Encouraging to suicide, or commit criminal offences, terrorist acts, eulogizing war crimes or crimes against humanity. * Allowing a third party to collect directly or indirectly hacked software, software register numbers, software enabling hacking and intrusion in computer systems, viruses and other software interfering with people rights or safety of individuals and goods. The user promises to respect individuals right, and particularly: * Personality rights (such as the image, the private life). * Brand rights. * Royalties (notably on software, sound, image, photo, text, animated image) and close rights (artist, audio and video producer, data base producer). 7- PROPERTY OF DATA RESULTING FROM THE SERVICE USE Even if Weborama collects and dispatches freely the data to its subscribers in the scope of its Weboscope Free service, the company is and remains owner of these data. 8- WEBORAMA PROFESSIONAL ETHICS Weborama is a public limited company totally independent from another company or website. Each website is processed equally and the measurement method is the same for everyone. 9- FILES CREATION BY THE SUBSCRIBERS Every personal data file creation is bound by authorisation and/or declaration to the CNIL, in appliance to the law regarding Computing and Liberty (January 6 1978). The user promises to respect all the requirements relative to the creation of those files. 10- CREATION BY WEBORAMA OF A FILE RELATIVE TO USERS 10.1 WEBORAMA creates a file containing information about all users. This information collection is aimed at managing the users' account and these data is processed to establish statistics which can be communicated and used anonymously with any third party. The user immediately accepts the creation of this file. 10.2 WEBORAMA, in the scope of its commercial development, establishes a file of webmasters e-mail addresses. WEBORAMA may send messages featuring commercial contents to these people. The diffusion is always initiated from WEBORAMA. WEBORAMA allows subscribers of this diffusion list to cancel easily their registration. The e-mail list is not distributed outside of WEBORAMA. 11- PERSONAL DATA PROTECTION - MODIFICATION RIGHT In appliance to the law n° 78-17 of January 6 1978 relative to computing, files and liberty, each subscriber has a right of opposition, access and reply of data regarding her/him. Thus, she/he can demand that these data be modified, completed, clarified, updated or deleted if they are wrong, incomplete, ambiguous, outdated or if the collection or use or communication of these data is forbidden. Each subscriber may exercise this right at any time by accessing her/his Customer Area, in the section « Installation - Configuration », chapter "Customer Account Information". When closing the account, the data regarding the subscriber are kept confidential and archived, for a period set by WEBORAMA and according to the art. 2262 of the Civil Code (French Common Law). In accordance to the law, Weborama declared to the CNIL the constitution and management of this subscribers file. This declaration is recorded under the number 743 097. 12- "COOKIE" FILES In the scope of its activities, Weborama uses the "cookie" files technology. 12.1- Weborama's "cookie" files * "AFFICHE_W" contains the ID of your browser; it is installed during your first visit to one of the websites of Weborama.fr network. * "WEBO_SOND" or "WEBO_VOTE" contain your birthday date, your gender, your socio-professional group; they are installed on your browser when you have answered to the "profile" poll. * "wbospeed" and "wbospeed2" contain the result of your connection speed computation. This is useful to determine the possibility to use or not pages requiring broadband connection. * "tr_XXXXX" contains the cookie allowing the establishment of real-time visits statistics (this functionality is available only for professional accounts). * "aimfarcapping" contains the ID of viewed advertising messages, in order to not overexpose a web user to advertising messages. * "wous" contains the most popular subject and connection time of the web user regarding her/his visits on the websites of Weborama.fr directory. Some other cookies relative to the authentication and security in your Customer Area may be installed. They usually correspond to the period of your browsing session. 12.2- How to delete "cookie" files that are already installed on your browser (under Windows with Internet Explorer): * Go to your "My computer" * Research the fold “Temporary Internet Files” (for the previous versions to Windows 2000) or “Cookies” (Windows 2000 and XP) * Select all the files (CTRL A) * Choose the option "delete" * Once this step is finished, if you wish to forbid any other "cookie" files installation, you have to follow the process mentioned at the following point: 12.3. If you use other operating system and/or browser configuration, please refer to their documentation. 12.3- How to reject cookies or be informed when cookies are set up? You can reject the installation of "cookies" by configuring your browser as following: * If you surf with Internet Explorer 3 or 4 (Microsoft) : click "View", "Option", "Advanced". Among different warnings you can activate, the fourth is entitled "Warn before accepting cookies" and only on Internet Explorer 4, the fifth is entitled "Always reject cookies". * If you surf with Internet Explorer 5 or 6 (Microsoft), you can : either use the previous method, in clicking "Tools", "Internet options", "Advanced", or configure your parameters in the tab "Privacy" from the menu "Tools", "Internet options * If you surf with Navigator Free 3 or 4 (Netscape) : Click "Options", "Favourite network", "Protocols". Among different warnings you can activate, the first is entitled "Warn before accepting cookies". You will be then informed when a cookie is about to be installed and you will be in position to reject it with your Internet browser. * If you surf with Mozilla : an interface dedicated to the management of cookies is located in the menu "Tools", "Cookies management". If you use other operating systems and/or browser configurations, please read about their documentation. 13- SERVICE AVAILABILITY WEBORAMA does its best to keep its Weboscope Free service accessible and sets all its services available 24/7. However, the company has no obligation to achieve this. WEBORAMA may thus stop the access, and particularly for maintenance and update reasons, or for any other reasons (usually technical reasons). WEBORAMA cannot be responsible for this interruptions and consequences that may come up for the user. The free character of the service notably may explain this. WEBORAMA can put an end or modify the characteristics of its services at any time, and without any notice. 14- CONTRACT DURATION The current contract is applicable since the subscriber accepts it, and since WEBORAMA confirms to her/him the opening of her/his account. The period is thus not limited. Each part can put an end to this contract without notice and explanation. 15- BREACH OF CONTRACT - LIABILITY In case of failure to comply with the provisions of these general conditions, WEBORAMA reserves the right to suspend the subscriber's access to her/his account without prior notice. 16- MISCELLANEOUS The parts agree that WEBORAMA can modify its service and/or the terms of the current general conditions, considering the services technical evolution. WEBORAMA commits itself to inform the user regarding potential modifications. Nevertheless, all the modifications are communicated in this conditions, therefore, the users have to take acknowledge of them.
